End User Terms and Conditions

Definitions

For purposes of these Terms, the following definitions apply:

"Company"

means Korber Art LLC, the provider and operator of the Platform.

"Platform"

means the public-facing website, web-based forms, mobile applications, supporting mobile technologies (as applicable), SMS notification services, and related technology provided by the Company to facilitate communications and information exchange between End Users and Participating Organizations. Unless expressly stated otherwise, the Platform does not include administration portals or other services intended solely for use by Participating Organizations.

"Participating Organization"

means any pharmacy, clinic, physician practice, healthcare provider, healthcare facility, or other organization that has entered into an agreement with the Company to use the Platform and that makes the Platform available to End Users in connection with the services it provides.

"Patient"

means an individual who receives or seeks to receive services from a Participating Organization.

"End User"

means any individual who is authorized or otherwise permitted to access or use the Platform, whether on their own behalf or on behalf of another person, including a Patient, parent, legal guardian, caregiver, authorized representative, family member, or other individual authorized by a Participating Organization or by applicable law to use the Platform.

"Protected Health Information" or "PHI"

has the meaning assigned under the Health Insurance Portability and Accountability Act of 1996 ("HIPAA") and its implementing regulations, as amended. References to PHI in these Terms are intended solely to describe information that may be processed through the Platform in connection with the services provided by Participating Organizations and do not create, modify, expand, limit, or otherwise affect the respective legal rights or responsibilities of the Company or any Participating Organization under HIPAA or any other applicable law.

"Platform Services"

means the communication, information transmission, messaging, notification, functionality, features, tools, and related technology services provided by the Company through or in connection with the Platform.

"Transactional SMS Message"

means a text message transmitted through or in connection with the Platform in relation to an End User's interaction with a Participating Organization, including confirmation messages, status updates, requests to contact the Participating Organization, or other operational communications.

About the Platform

The Platform is a technology service licensed to Participating Organizations and designed to facilitate the submission, communication, and exchange of information between End Users and Participating Organizations. It enables End Users, where made available by a Participating Organization, to submit requests, forms, documents, and other information to the Participating Organization and to receive service-related communications from the Participating Organization through or in connection with the Platform.

The Platform may allow End Users to securely submit images of prescriptions, identification, insurance or medical cards, documents, and related information to a Participating Organization for its review and processing. The Platform facilitates the transmission of this information and does not determine whether any prescription, document, identification, card, or other information satisfies the requirements applicable to the services provided by the Participating Organization. The Participating Organization is responsible for determining the requirements applicable to its services.

Images or copies submitted through the Platform are not substitutes for the original prescriptions, identification, cards, documents, or other materials from which they were created. You should retain all originals and present them to the Participating Organization when required in connection with its services. In all cases, you must retain the original prescription and present it to the Participating Organization to receive the medication. Submission of an image of a prescription through the Platform is not electronic prescribing (e-prescribing) and does not transmit an electronic prescription. Submission through the Platform does not constitute acceptance, approval, or dispensing of a prescription or acceptance or approval of any other document or request by the Participating Organization.

The Company provides the Platform and related technology services to Participating Organizations only. Except as expressly provided in these Terms, the Company does not provide services directly to End Users.

The Company is solely a technology service provider and is not a pharmacy, healthcare provider, healthcare practitioner, healthcare facility, insurer, emergency service, or other provider of healthcare or healthcare-related services.

The Participating Organization—not the Company—is solely responsible for the services it provides and for its decisions regarding its use of the Platform, including professional advice, diagnosis, treatment decisions, prescriptions, communications relating to your care, and other services it provides.

Nothing in these Terms or the Platform is intended to create, and nothing shall be construed as creating, any agency, partnership, joint venture, employment, fiduciary, or similar relationship between the Company and any Participating Organization. Each acts as an independent entity in connection with its respective activities.

Unless expressly stated otherwise in these Terms or another applicable legal document of the Company, statements, notices, icons, labels, badges, indicators, and other information presented as part of the Platform are provided for general informational or descriptive purposes. They do not create contractual commitments, guarantees, warranties, or representations beyond those expressly set forth in these Terms or another applicable legal document of the Company, nor do they constitute representations, warranties, or commitments by any Participating Organization regarding the services it provides.

The Company provides the Platform solely as a technology service provider. Nothing in these Terms is intended to create, modify, expand, limit, or otherwise affect the respective legal rights or responsibilities of the Company, any Participating Organization, or any End User under HIPAA or any other applicable law.

Eligibility

You may use the Platform only if you are legally permitted to do so.

The Platform is not intended for independent use by individuals who lack the legal capacity or legal authority to use it on their own behalf. Such individuals may access or use the Platform only through a parent, legal guardian, authorized representative, or other person legally authorized to act on their behalf.

If you access or use the Platform on behalf of another individual, including a minor child or a person for whom you are legally authorized to act, you represent and warrant that you have the legal authority to do so and to submit information through the Platform on that individual's behalf.

The Company has no obligation to verify your identity, age, legal capacity, legal authority, relationship to another individual, or authorization to access or use the Platform or to act on behalf of another individual. The Company may rely on the representations and information you provide in connection with your use of the Platform.

No Medical Advice

The Platform is provided solely as a technology and communication tool.

The Company does not provide healthcare services, medical care, diagnosis, treatment, or healthcare advice.

The Platform is not designed or intended for emergency communications or other time-sensitive medical situations. You should not rely on the Platform to report a medical emergency, obtain emergency assistance, or receive an immediate response. The Company has no obligation to identify, prioritize, monitor, or respond to emergency or time-sensitive communications submitted through the Platform.

The Company does not:

• provide medical advice;
• diagnose medical conditions;
• prescribe medication;
• recommend treatment;
• monitor your health;
• review or evaluate submissions for clinical decision-making; or
• make healthcare decisions.

The Company has no obligation to monitor submissions made through the Platform, verify that any communication has been received, reviewed, or acted upon by a Participating Organization, or follow up regarding any submission. End Users remain responsible for contacting the Participating Organization directly when appropriate, including if they do not receive a timely response.

Questions regarding prescriptions, appointment requests, treatment, medical care, or other services provided by a Participating Organization should always be directed to that Participating Organization or your healthcare provider, as applicable.

Do not use the Platform to report or seek assistance for a medical emergency.

If you believe you are experiencing a medical emergency, immediately call 911 or your local emergency services.

Your Relationship with the Participating Organization

The Participating Organization determines which available Platform features, forms, and communication options it chooses to use, what information it requests through those available features, how information submitted through the Platform is used, whether service-related communications are sent, how long information is retained, and how the services it provides are delivered.

The Company provides the Platform through which communications between End Users and Participating Organizations may occur. Questions or requests relating to a Participating Organization, the services it provides, or an End User's use of the Platform should be directed to the Participating Organization and not to the Company. Except as expressly provided in these Terms, the Company does not undertake to communicate with End Users regarding such matters.

The Platform is designed primarily to facilitate the transmission of information between End Users and Participating Organizations and is not intended to serve as the Participating Organization's permanent records management system. Participating Organizations remain responsible for maintaining records in accordance with applicable law and their own record-retention policies.

The Participating Organization is solely responsible for its decisions regarding its use of the Platform, including its selection of available features, the information it requests, the communications it configures, initiates, authorizes, or sends, the retention of information, and the services it provides. The Company does not direct or control those decisions.

Records and Information Retention

The Platform is designed primarily to facilitate the transmission of information between End Users and Participating Organizations. It is not intended to serve as a long-term repository, archive, backup, or records management system for End Users or Participating Organizations.

Participating Organizations remain solely responsible for maintaining records in accordance with applicable law and their own record retention policies. End Users should retain copies of any information they wish to preserve and should not rely on the Platform as the sole or permanent repository of information submitted through the Platform.

The Company may retain certain information for operational, security, legal, contractual, backup, disaster recovery, or other legitimate business purposes, as further described in the Company's End User Privacy Policy.

The Company does not guarantee that information submitted through the Platform will be retained for any particular period, remain available for future retrieval, or be recoverable after transmission, processing, deletion, or removal from the Platform.

Transactional SMS Communications

If you provide a mobile telephone number in connection with a request submitted through the Platform, or if a Participating Organization provides your mobile telephone number for purposes of service-related communications, the Platform may be used to facilitate the transmission of text messages through one or more third-party messaging service providers.

These messages may include:

• confirmation that your request has been received;
• a confirmation or reference number;
• status updates relating to your request, where enabled or configured by the participating organization;
• requests to contact the Participating Organization; or
• other operational communications relating to your interaction with the Participating Organization.

The Platform may automatically generate certain operational communications as part of its standard functionality and may also provide Participating Organizations with tools to configure, initiate, or transmit other communications. Participating organizations are responsible for their use of the Platform's messaging functionality, including communications they configure, initiate, or authorize for transmission through the Platform, and for ensuring that such communications comply with applicable law and are appropriate for their intended purpose. The Company does not review, monitor, approve, verify, or control communications transmitted by Participating Organizations through the Platform.

The Platform's SMS functionality is intended to facilitate operational communications relating to an End User's interaction with a Participating Organization. Transactional SMS Messages are transmitted through wireless carriers and third-party messaging service providers and are not a secure method of communication. The Platform is designed to avoid including sensitive health information, such as diagnoses, medical conditions, prescription names, appointment details, or other confidential healthcare information, in SMS messages. End Users should not rely on SMS for the transmission of sensitive, confidential, or time-sensitive information.

The content of Transactional SMS Messages is determined by the Participating Organization using the Platform. While the Platform may provide message templates or other messaging tools, Participating Organizations are responsible for configuring, selecting, modifying, and sending the content of communications delivered on their behalf, including ensuring that such communications comply with applicable law and are appropriate for their intended purpose.

By voluntarily providing your mobile telephone number to a Participating Organization through the Platform, or by otherwise providing your mobile telephone number directly to a Participating Organization for purposes of receiving service-related communications, you consent to receive text messages transmitted through the Platform in connection with your interactions with that participating organization.

You are responsible for providing a current and accurate mobile telephone number that you are authorized to use. You acknowledge that text messages transmitted through the Platform may be delivered to the mobile telephone number provided in connection with your request or otherwise provided to the Participating Organization for service-related communications. The Company and the participating organization are entitled to rely on the telephone number provided unless and until it is updated. The Company is not responsible for messages delivered to an incorrect, reassigned, outdated, or unauthorized telephone number resulting from inaccurate, incomplete, or outdated information provided by you or to the Participating Organization.

Message frequency varies depending on your interactions with the Participating Organization.

Standard message and data rates may apply.

Delivery of text messages depends on your wireless carrier, third-party messaging service providers, and other third-party service providers and cannot be guaranteed.

If your mobile telephone number changes, you should promptly notify the Participating Organization.

Your Responsibilities

You agree to:

• be solely responsible for the completeness and accuracy of information you submit through the Platform;
• retain the original prescription and present it to the Participating Organization when receiving the medication;
• provide a telephone number that you are authorized to use;
• avoid submitting false or misleading information;
• use the Platform only for lawful purposes and legitimate use in connection with the services provided by the Participating Organization; and
• maintain the security of any device you use to access the Platform.

Prohibited Uses

You may not:

• use the Platform for unlawful purposes;
• interfere with the operation or security of the Platform;
• upload malware or malicious software;
• attempt unauthorized access to the Platform;
• submit fraudulent information;
• use automated systems to interfere with the normal operation of the Platform; or
• misuse the Platform in any manner that could impair its availability or operation for others.

Availability

The Company may make the Platform available but does not undertake or guarantee that the Platform will be available at any particular time or without interruption.

The Platform requires an active internet connection for most functionality. The Company does not guarantee the successful transmission, receipt, processing, or delivery of requests or communications, uninterrupted availability of the Platform, or that any request or communication will be received, reviewed, or acted upon by a Participating Organization within any particular timeframe.

Technical Compatibility. Access to and use of the Platform may require a compatible device, operating system, browser, mobile application, network connection, and other third-party technology. The Company does not guarantee that the Platform will operate properly on unsupported, outdated, modified, incompatible, or unpatched hardware, software, browsers, operating systems, devices, or network environments. You are responsible for using and maintaining technology reasonably capable of accessing the Platform.

The Platform may occasionally be unavailable or experience delays due to:

• maintenance;
• software updates;
• network failures;
• third-party service interruptions; or
• events beyond the Company's reasonable control.

A confirmation screen, confirmation number, or Transactional SMS Message indicates only that the Platform has successfully received or processed your submission for delivery. It does not guarantee that the Participating Organization has received, reviewed, accepted, acted upon, or completed your request.

External Websites and Services

The Platform may contain links to websites, applications, resources, or services operated by Participating Organizations, government agencies, healthcare organizations, or other third parties for your convenience.

The Company does not own, operate, control, or endorse any third-party website, application, resource, or service and is not responsible for its availability, accuracy, completeness, content, security, privacy practices, terms of use, or the products or services it provides.

Any information made available by a third-party website or service, including educational or healthcare-related information, is provided solely by that third party. The Company does not verify, adopt, or make any representation or warranty regarding such information and is not responsible for any action or decision you make in reliance on it.

Your use of any third-party website or service is solely at your own risk and is governed by the terms, conditions, and privacy policies applicable to that website or service.

Intellectual Property

The Platform, including its software, design, trademarks, logos, documentation, and content, is owned by or licensed to the Company and is protected by applicable intellectual property laws.

These Terms grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform solely for its intended purpose.

No ownership rights are transferred to you.

Privacy

Your use of the Platform is also governed by the Company's End User Privacy Policy, which describes the Company's privacy and information handling practices, including its retention of information processed through the Platform.

The Company's End User Privacy Policy describes the Company's privacy practices solely in its capacity as the provider and operator of the Platform.

The Participating Organization may maintain its own privacy practices, including any applicable Notice of Privacy Practices, and is responsible for its own collection, use, retention, and disclosure of information, and for its compliance with applicable privacy and healthcare laws.

Suspension or Termination

The Company or the Participating Organization may suspend, restrict, block, or terminate your access to the Platform or particular Platform Services or features if:

• required by applicable law;
• reasonably necessary to protect the security, integrity, or availability of the Platform;
• the Platform or applicable Platform Services are discontinued; or
• you violate these Terms.

Suspension, restriction, blocking, or termination does not affect any legal rights or obligations that accrued before such action.

Survival

Any provision of these Terms that by its nature should survive the suspension, termination, or expiration of these Terms or your use of the Platform shall survive, including, without limitation, provisions relating to intellectual property, records and information retention, disclaimers, limitations of liability, indemnification, governing law, venue, severability, and any payment obligations, if applicable.

Disclaimer of Warranties

THE PLATFORM AND ANY RELATED TECHNOLOGY SERVICES PROVIDED BY THE COMPANY ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS INTERRUPTION, LOSS OF USE, LOSS OF OPPORTUNITY, EMOTIONAL DISTRESS, MENTAL ANGUISH, OR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, ANY RELATED TECHNOLOGY SERVICES, OR YOUR USE OF OR INABILITY TO USE THE PLATFORM, REGARDLESS OF THE LEGAL THEORY ASSERTED, INCLUDING CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR OTHERWISE, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY IS NOT LIABLE FOR ANY DAMAGES, LOSSES, CLAIMS, OR LIABILITY ARISING FROM OR RELATING TO:

• healthcare decisions, professional judgment, or services provided by a Participating Organization or other healthcare provider;
• services provided by a Participating Organization;
• medical advice, diagnosis, treatment, or the lack thereof;
• the content, accuracy, completeness, legality, or appropriateness of information submitted, transmitted, or communicated by End Users or a Participating Organization;
• delays, omissions, errors, failures to respond, or other actions or inactions of a Participating Organization or other healthcare provider;
• the failure of an End User to provide accurate, complete, or current information, including an incorrect or unauthorized telephone number, email address, or other contact information;
• the disclosure of information resulting from inaccurate or unauthorized contact information provided by an End User or by a Participating Organization;
• delays, failures, or interruptions of wireless carriers, telecommunications providers, internet service providers, cloud service providers, SMS providers, or other third-party service providers;
• failures, interruptions, delays, security incidents, or unavailability of the internet or other communication networks;
• the use of unsupported, outdated, modified, incompatible, or unpatched hardware, software, browsers, operating systems, devices, or network environments;
• the inability to successfully transmit, receive, process, deliver, review, retrieve, or retain any communication, request, submission, attachment, image, document, or other information submitted through the Platform;
• any reliance on a confirmation screen, confirmation number, Transactional SMS Message, or similar notification as evidence that a Participating Organization has received, reviewed, accepted, acted upon, or completed a request; or
• events beyond the Company's reasonable control.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS, THE PLATFORM, ANY RELATED TECHNOLOGY SERVICES, OR YOUR USE OF OR INABILITY TO USE THE PLATFORM, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, STATUTE, OR ANY OTHER LEGAL THEORY, SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT, IF ANY, PAID BY YOU TO THE COMPANY FOR USE OF THE PLATFORM DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) US$100.

YOU ACKNOWLEDGE AND AGREE THAT THE LIMITATIONS OF LIABILITY SET FORTH IN THESE TERMS REFLECT A REASONABLE ALLOCATION OF RISK BETWEEN YOU AND THE COMPANY, ARE AN ESSENTIAL BASIS OF THE AGREEMENT BETWEEN YOU AND THE COMPANY, AND THAT THE COMPANY WOULD NOT MAKE THE PLATFORM AVAILABLE ON THE SAME TERMS WITHOUT THESE LIMITATIONS.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR LIABILITIES. IN THOSE JURISDICTIONS, THE ABOVE LIMITATIONS SHALL APPLY ONLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

Indemnification

To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, contractors, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your misuse of the Platform or any related technology services provided by the Company, your violation of these Terms, your violation of applicable law, your violation of the rights of any third party, or any information, content, documents, images, files, or other materials submitted by you through the Platform.

Changes to These Terms

The Company may update these Terms from time to time.

When changes are made, the revised Terms will be posted at:

The revised Terms become effective on the Effective Date identified above or otherwise indicated in the revised Terms. Your continued use of the Platform after the revised Terms become effective constitutes your acceptance of the updated Terms.

Notices

Except to the extent expressly required by applicable law, the Company does not undertake to provide direct or individualized notices to End Users regarding security incidents, service interruptions, Platform changes, or other matters. Any notice obligations between the Company and a Participating Organization are governed solely by applicable law and the separate agreement between the Company and that Participating Organization and do not create rights or remedies in favor of End Users or other third parties.

Governing Law

These Terms are governed by the laws of the State of Oregon, without regard to its conflict of laws principles.

Any legal proceeding arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in the State of Oregon, and you consent to the personal jurisdiction and venue of those courts, except to the extent applicable law requires otherwise.

Severability

If any provision of these Terms is determined to be invalid, illegal, or unenforceable, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain in full force and effect.

No Waiver

No failure or delay by the Company in exercising any right, remedy, power, or privilege under these Terms shall operate as a waiver thereof. Any waiver shall be effective only if made expressly in writing by the Company and shall not be deemed a waiver of any subsequent breach or default.

No Assignment

You may not assign, transfer, delegate, or otherwise convey any of your rights or obligations under these Terms without the Company's prior written consent. The Company may assign or transfer its rights or obligations under these Terms without restriction, including in connection with a merger, acquisition, corporate reorganization, or sale of assets.

No Third-Party Beneficiaries

Except as expressly provided in these Terms, these Terms are intended solely for the benefit of you and the Company and do not create any rights or remedies in favor of any other person or entity.

Entire Agreement

These Terms, together with the Company's End User Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Platform.

These Terms do not replace, modify, or supersede any agreement between the Company and any Participating Organization, nor do they alter any relationship between you and the Participating Organization.

Force Majeure

The Company shall not be liable for any delay, interruption, failure, or inability to perform any obligation under these Terms to the extent resulting from causes beyond its reasonable control, including acts of God, natural disasters, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labor disputes, governmental actions, failures or interruptions of utilities, telecommunications providers, internet service providers, cloud service providers, or other third-party service providers, cyberattacks, denial-of-service attacks, widespread software or infrastructure failures, or any other event beyond the Company's reasonable control.

Headings

Section titles and headings are provided solely for convenience and shall not affect the interpretation of these Terms.

Language

These Terms may be made available in languages other than English for convenience. In the event of any conflict, inconsistency, or ambiguity between the English version and any translated version, the English version shall govern to the fullest extent permitted by applicable law.

Technical Issue Reporting

The Company may, in its sole discretion, make available a mechanism through which End Users may report issues relating to the operation of the Platform. Questions or concerns regarding your use of the Platform should first be directed to the Participating Organization. Any mechanism provided by the Company for reporting technical issues is supplemental, is provided solely as a convenience, and is not intended to replace communications with the Participating Organization or any assistance the Participating Organization may provide, or to serve as a communication channel with the Participating Organization.

Questions regarding services provided by the Participating Organization, requests submitted through the Platform, healthcare information, or any matter relating to your care should always be directed to the Participating Organization.

Submitting a report through the Company's technical issue reporting mechanism does not constitute notice to the Participating Organization or satisfy any obligation to notify or communicate with the Participating Organization.

Technical issue reporting channels are not intended for the submission of Protected Health Information or other sensitive healthcare information. You should not submit Protected Health Information or other sensitive healthcare information through such channels.

The Company may use information voluntarily submitted through technical issue reporting channels in connection with investigating, communicating regarding, and, in its sole discretion, attempting to address reported technical issues, as further described in the Company's End User Privacy Policy.

If a communication submitted through the Company's technical issue reporting channels appears to be intended for the Participating Organization or relates primarily to the Participating Organization's services or healthcare matters, the Company may, but is not obligated to, forward the communication to the Participating Organization or notify the Participating Organization of the communication. The Company has no obligation to receive, review, forward, transmit, deliver, respond to, monitor, or otherwise act upon such communications. You remain solely responsible for contacting the Participating Organization directly and for ensuring that the Participating Organization receives any communication intended for it.

Nothing in this Section creates any duty or obligation on the part of the Company to provide customer support, technical support, help desk services, or other assistance to any End User. The Company does not guarantee the availability of any issue reporting mechanism or that any reported technical issue will receive a response, be investigated, be acted upon, be corrected, or be addressed within any particular timeframe or at all.
